The package price does not include the fees charged by the relevant trademark offices. These are advanced by us and invoiced together with our fee.

Depending on your advisory needs, you have a choice between the service package and additional complementary individual services. These are agreed separately and are invoiced at a flat fixed fee or by the hour based on our fee rate.

What is a trademark and what distinguishes it from a patent or a design?
A trademark identifies the goods and/or services you offer and differentiates them from those of your competitors. It's like a business card for your goods and services on the competitive market. A trademark may take the form of a word (e.g. the name of your company or your product), a logo or a combination of the two.

This is the main difference between a trademark and a patent, which provides protection for the technical nature of your product or an innovative manufacturing process. Meanwhile, a registered design ensures you a temporary monopoly on the appearance of your product, such as its shape and colour.

What do I need to be mindful of when registering a trademark?
Trademark protection offers many options. A trademark may consist of a word, a combination of words, letters or numbers, even images, symbols or three-dimensional renderings, sounds, scents or flavours. However, you will only receive protection for the goods and services specified by you when registering your trademark, which have to be assigned to various categories. It is no longer possible to expand the scope of protection once the trademark has been registered. You should therefore already know prior to registering your trademark which goods and services you want to use your trademark for in the future.

It is of utmost importance that you pursue the right strategy when registering your trademark to protect your trademark as effectively as possible. It is equally important that you comply with certain formalities, as incorrect wording and misstatements can lead to objections or, in the worst case, your trademark registration being rejected.

Why should I conduct prior research into similar or identical existing trademarks?
One of the key requirements for registering a trademark is that it does not infringe on existing trademark rights. As the majority of offices do not check for pre-existing trademark rights on their own initiative, it is sensible to conduct your own research prior to submitting your application. By conducting research into identical or similar trademarks and/or your company name prior to registering your trademark, you can avoid infringing on existing trademark rights and any expensive trademark disputes, injunctive relief or damage claims resulting from this.
